The Utah Department of Commerce recently announced enforcement action against three e-cigarette companies for alleged violations of state consumer protection laws. A copy of the Department’s press release is attached here: 14-08-27_dcp-e-cigarette
The claims against the companies pertain to advertising that the products could be “smoked anywhere” in alleged violation of the State Indoor Clean Air Act. Other claims pertained to advertising that the products were healthier alternatives to cigarettes and could reduce health risks. The companies also were cited for misleading marketing of “free” trial offers. It appears that one of the companies has settled the charges, with charges pending against the other two.
